The only thing that I know of that would be restricting them (in my limited Business education) is if they are offering the incentive to another dealer they must legally offer it to every dealer AS LONG AS it can be proven that there is no way of distinguishing between the two. However, if the dealers don't do the same amount of volume, are not in the same geographical region, etc, then they don't necessarily have to be treated equally with respect to mfg pricing.

It seems to me though that MS was using the same tactics with all OEMs, not just Compaq, so I don't see how it could be considered unfair. I think BeOS did itself in, plain and simple.
